OUT-OF-COMPETITION CONTESTATION OF TRANSACTIONS FOR WITHDRAWAL OF THE DEBTOR'S ASSETS
The client applied to VILEX to accompany the enforcement proceedings to collect the debt from the debtor - an individual. As part of the enforcement proceedings, bans were imposed on the commission of registration actions with the debtor's shares in several organizations, although these companies did not actually conduct economic activities.
After familiarization with the materials, it was established that the enforcement proceedings were terminated, and the prohibitions on registration actions with shares were lifted and the debtor was able to alienate the share to another individual. The transaction was notarized, the calculation was carried out.
VILEX GROUP lawyers prepared and filed a claim to invalidate the transaction for the alienation of shares, considering that the debtor had the goal of hiding the property from recovery.
The arbitration court satisfied the plaintiff's claims in full, and the shares in the authorized capitals of the companies were returned to the ownership of the debtor. The outcome of the dispute allowed the client to achieve debt repayment by concluding an amicable agreement with the parties to the dispute.
