PROTECTION OF BANKRUPT BENEFICIARIES AGAINST SUBSIDIARY LIABILITY

The Arbitration Court of the Republic of Tatarstan completed the consideration of a separate dispute on bringing to subsidiary liability the founders and director of the debtor in the amount of more than 30 million rubles.

The defendants were charged with the following offences:
- making unprofitable transactions for the company;
- withdrawal of assets under fictitious transactions to affiliated organizations;
- non-collection of receivables from affiliates.

The court rejected the arguments of the manager and admitted that the disputed transactions did not harm the society. The outcome of a separate dispute will successfully complete the personal bankruptcy proceedings of managers.
