PROTECTION OF INTERESTS OF THE CONTROLLING PERSON IN A DISPUTE ABOUT RECOVERY OF DAMAGES

The Arbitration Court of the Republic of Tatarstan refused to accept the bankruptcy commissioner's application to recover damages from the former head of the bankrupt company. The claims were lodged to bankruptcy commissioners related to the conclusion of unprofitable transactions and a shortage of material assets - the total amount of claims reached  50 million rubles.

During the consideration of the case, it was possible to restore the primary documentation of the debtor held by the counterparty, as well as to prove the economic feasibility of the transactions concluded by the head. The successful outcome of isolated disputes made it possible to reduce the risk of bringing the bankruptcy commissioner to subsidiary liability.
