PROTECTION OF THE FORMER HEAD IN THE DISPUTE ABOUT SUBSIDIARY LIABILITY IN THE COURT OF GENERAL JURISDICTION

A court of general jurisdiction of one of the districts of the Republic of Tatarstan issued a decision to dismiss the claim of the Federal Tax Service on bringing the former head to subsidiary liability. In relation to the organization itself, bankruptcy proceedings were not initiated, but the head was previously brought to administrative responsibility for failure to file a bankruptcy petition.

The lawyers succeeded in proving the inconsistency of the position of the Federal Tax Service with the norms of the Bankruptcy Law, and the considered case became important for judicial practice for disputes on bringing managers to subsidiary liability outside the framework of the bankruptcy case.
